1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of the BlivoAI platform, including our website at blivoai.com and all related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

You must be at least 13 years of age to use the Service. By using the Service, you represent and warrant that you are at least 13 years old and have the legal capacity to enter into these Terms. If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

2. Account Registration

To access certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during the registration process and to keep your account information updated. You are responsible for safeguarding your account password and for all activities that occur under your account. You agree to notify BlivoAI immediately of any unauthorized use of your account.

We reserve the right to suspend or terminate your account if any information provided proves to be inaccurate, not current, or incomplete, or if we have reasonable grounds to suspect fraud, abuse, or violation of these Terms. You may delete your account at any time through the platform settings, subject to the data retention provisions in our Privacy Policy.

3. Subscription Plans and Payments

BlivoAI offers multiple subscription plans including a Free plan, Basic plan, and Pro plan. Each plan has specific usage limits, including monthly token allowances and feature access, as described on our pricing page. Plan details and pricing are subject to change with reasonable notice.

3.1 Billing and Payments

Paid plans are billed on a monthly basis. Payments are processed through PayPal. By subscribing to a paid plan, you authorize BlivoAI to charge the applicable fees to your payment method. All fees are non-refundable except as expressly set forth in these Terms or required by applicable law. Subscription fees will be charged at the beginning of each billing cycle.

3.2 Plan Changes and Cancellation

You may upgrade or downgrade your plan at any time. When upgrading, the new rate takes effect immediately and you will be charged a prorated amount for the remainder of the billing cycle. When downgrading, the change takes effect at the start of the next billing cycle. You may cancel your subscription at any time; cancellation will take effect at the end of the current billing period. Upon cancellation, your account will revert to the Free plan.

4. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to use the Service in any way that violates any applicable federal, state, local, or international law or regulation. You are solely responsible for the content of your messages and the manner in which you use the AI models provided through the Service.

4.1 Prohibited Uses

• Generating content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
• Attempting to reverse engineer, decompile, or disassemble any aspect of the Service
• Using the Service to generate malware, phishing content, or other malicious materials
• Impersonating any person or entity or misrepresenting your affiliation with any person or entity
• Interfering with or disrupting the integrity or performance of the Service
• Attempting to gain unauthorized access to any portion of the Service or any related systems or networks
• Using automated tools or scripts to access the Service in a manner that exceeds reasonable usage limits
• Sharing your account credentials with third parties or allowing others to use your account

5. AI-Generated Content

The Service provides access to AI models that generate responses based on your input. You acknowledge and agree that AI-generated content may not always be accurate, complete, or appropriate for your intended use. BlivoAI does not guarantee the accuracy, reliability, or quality of any AI-generated content. You are responsible for reviewing, verifying, and determining the suitability of any AI-generated content for your purposes.

AI-generated content should not be used as a substitute for professional advice, including but not limited to medical, legal, financial, or engineering advice. BlivoAI is not liable for any decisions made or actions taken based on AI-generated content. You retain responsibility for how you use and distribute content generated through the Service.

6. Intellectual Property

The Service and its original content (excluding content provided by users and AI-generated responses), features, and functionality are and will remain the exclusive property of BlivoAI and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of BlivoAI.

You retain ownership of the content you input into the Service. AI-generated responses are provided for your use, and you may use such content in accordance with applicable law and these Terms. BlivoAI does not claim ownership of your input content or the AI-generated responses provided to you.

7. Limitation of Liability

To the fullest extent permitted by applicable law, BlivoAI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of (or inability to access or use) the Service; any conduct or content of any third party on the Service; any content obtained from the Service; or unauthorized access, use, or alteration of your transmissions or content. In no event shall BlivoAI's aggregate liability exceed the amount you have paid to BlivoAI in the twelve months preceding the claim.

8. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease. Provisions of the Terms which by their nature should survive termination shall survive, including without limitation ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

9. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
